Rules for using our service.

These Terms & Conditions ("Terms") govern your access to and use of the WhatsTheSpecial websites, applications, and related services (collectively, the "Service"). The Service is operated by James John Group, LLC, a Michigan limited liability company ("James John Group")("we," "us," or "our"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

The Service helps restaurants share specials and related information with diners and may include features such as listings, uploads (including photos or messages), reminders, and integrations with third-party tools (for example, authentication, messaging, or billing). We may modify, suspend, or discontinue any part of the Service with reasonable notice where practicable.
You may need an account to use certain features. You agree to provide accurate information, keep your credentials secure, and notify us promptly of unauthorized use. You are responsible for activity under your account. If you create or manage an account on behalf of a business, you represent that you have authority to bind that business to these Terms.
You retain ownership of content you submit ("Your Content"), such as photos, text, menu or special descriptions, and business information. You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, distribute, and otherwise use Your Content solely to operate, improve, and promote the Service—including publishing content you choose to make public.
You represent that you have all rights necessary to grant this license and that Your Content does not violate law or third-party rights. We may remove content that violates these Terms or that we reasonably believe is harmful or unlawful.

Some features require payment. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
Subscription fees, taxes, and billing terms are governed by Paddle's buyer terms and any checkout terms presented at purchase. Refunds are described in our Refund Policy: you may request a full refund of any subscription charge within 30 calendar days from the date that charge was processed.
We are not responsible for third-party services (including carriers, email/SMS providers, or payment processors), except as required by law.
The Service, including our branding, software, and materials (excluding Your Content), is owned by us or our licensors and is protected by intellectual property laws. Except for the limited rights expressly granted here, no rights are transferred to you.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant uninterrupted or error-free operation or that content will be accurate or complete.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US$100), EXCEPT WHERE PROHIBITED BY LAW.
You will defend, indemnify, and hold harmless James John Group, LLC, a Michigan limited liability company ("James John Group"), the WhatsTheSpecial service, and their respective affiliates, officers, directors, employees, and agents from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from Your Content, your use of the Service, or your violation of these Terms or applicable law.
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms, if we must comply with law, or for other legitimate reasons with notice where appropriate. Provisions that by their nature should survive will survive termination.
These Terms are governed by the laws of the State of Michigan, USA, without regard to conflict-of-law principles, except where preempted by applicable federal law. You agree to bring claims only in state or federal courts located in Michigan, and you consent to personal jurisdiction there.
We may update these Terms from time to time. We will post the revised Terms on this page and update the effective date. Continued use after changes constitutes acceptance of the revised Terms, to the extent permitted by law.
